The defense of infancy is a form of defense known as an excuse so that defendants falling within the definition of an "infant" are excluded from criminal liability for their actions, if at the relevant time, they had not reached an age of criminal responsibility. Might be going against the trend but I am not sure a 10 year old can be held accountable for some types of criminal behavior. If a child is delinquent at ten I would stick my neck out and suggest that unless there are some psychological issues (in that case not criminal) then this behavior is learnt. Q. Before i was ten i did illegal things but i was under the age of criminal responsibility so can i be charged at all.PS I am in NSW Australia and i don't do illegal things anymore. New laws usually have a start date (when they are passed into legislation) and they don't apply to past events.
