While the phrase age of consent typically does not appear in legal statutes, when used in relation to sexual activity, the age of consent is the minimum age at which a person is considered to be legally competent of consenting to sexual acts. The European Union calls it the legal age for sexual activities. It should not be confused with the age of majority, age of criminal responsibility, the marriageable age, the age at which one can purchase and consume alcoholic beverages, or drive a car. The age of consent varies from jurisdiction to jurisdiction. The relevant age may also vary by the type of sexual act, the gender of the actors, or other restrictions such as abuse of a position of trust. Some jurisdictions may also make allowances for minors engaged in sexual acts with each other, rather than a single age. Charges resulting from a breach of these laws may range from a relatively low-level misdemeanor such as corruption of a minor, to statutory rape (which is considered equivalent to rape, both in severity and sentencing). There are many grey areas in this area of law, some regarding unspecific and untried legislation, others brought about by debates regarding changing societal attitudes, and others due to conflicts between federal and state laws. These factors all make age of consent an often confusing subject, and a topic of highly charged debates. From Wikipedia under the
GNU Free Documentation License What exactly breaks the age of consent and what would my consequences be? Q. Um, In my state the age of consent is 17. I am 17, am I allowed to date younger people? And If I am, what exactly, can I do, how far can I go? Can I kiss? Makeout? Etc. And if I do break the age of consent, what exactly would happen to me. So how far am I allowed to go, everything besides ACTUAL sex? Asked by Ikuhara T - Fri Sep 26 18:56:54 2008 - - 3 Answers - 0 Comments A. Now that you are 17, you cannot have penetrative sex with someone under the age of 17, no matter how old you are. If you did & somebody found out and objected, you could be charged with statutory rape (even if she consented) and you would be placed on the sex offenders list. With this type of history, you would be open to barrage of abuse from society and refused numerous types of employment. This is even if she was your 16 year old childhood sweetheart who you have been dating for 6 years etc etc. You can date younger people as long as the relationship is not consummated by sexual intercourse. Answered by AnnieB - Fri Sep 26 19:08:48 2008 What is the age of consent in New York? What does age of consent really mean? Q. I was just wondering what the age of consent was and what that person can do legally once that person has reached the ago of consent. Asked by Emma W - Mon Sep 3 01:12:49 2007 - - 2 Answers - 0 Comments A. The age of consent in New York is 17. If the younger party is under 15 and the older is at least 18, this constitutes a 2nd degree sexual offense. However, if the older party is less than 4 years older than the victim, this may constitute an affirmative defense. Affirmative defenses are those in which the defendant introduces evidence which negates criminal liability. Answered by natliegirl - Mon Sep 3 19:46:35 2007 How does the age of consent work?
Q. My friends got into an argument after watching to catch a predator. I know every state has its own laws, but I think I read somewhere that you had to be a a certain age for it to apply? Or is it set in stone. Example, in CT the age of consent is 16. Does that mean anybody can have sexual relations with a 16 year old in the state of 16? Or do you have to be between 16-18? Asked by Ice Tea - Sun Jul 4 21:38:24 2010 - - 4 Answers - 0 Comments A. Some states have 'romeo and juliet' laws that allow two minors to have sex without problems if they are within a certain number of years. Not all states do have such laws. However, every state has an unrestricted age of consent (it is 16 in CT). At that age, it does not matter what the age of the other party (assuming they are also over 16). A 16 yr old can have sex with a 50 yr old if they want.
